Commentary

News reports don’t say much about the actual collision itself beyond the fact that it happened, so it’s possible that this was completely the fault of the car driver. But let’s assume for a moment that the driver of the cement truck was at least partially to blame. A lot of people assume that a lawyer like myself might want to get involved in the accident as quickly as possible so that we could sue the trucking company and make lots of money. That actually isn’t the case. I believe it’s always smart for victims in these accidents to bring in outside help as soon as possible, but only because after an accident like this takes place, time is running against you.

Actually being able to discover what happened in these sorts of accidents is only possible for a short time afterwards, and because trucking companies have so much to lose, they typically work against the victim’s interests to shove off as much of that liability as they can. If a trucking company is at fault, most people would assume that after the accident, everything is pretty cut and dry. They may wait for the insurance company to get involved, thinking it’s only a matter of time until the trucking company makes things right. That’s not the case. Companies like these typically have their own investigators and accident recontructionists, and they’re job is to see how much of the blame in an accident they can push on to the other side. Private investigations are usually one of the only ways to figure out what happened in a timely manner. It’s important for any victim to know that, after an accident, time is always of the essence.

I'm a former employee. I had brought up this exact scenario and suggested a maintenance procedure that would eliminate the possibility of this type injury. Obviously my warning went unheeded.

I was actually a couple cars back from this wreck, one of the first on the scene, and helped administer CPR on the victims. The truck driver was going way too fast, but it was actually his trailer that swung around and hit the suv, the semi-truck ended in the median.

A lot of people say smack about lawyers, but I want to say that I'm glad there is a way that people who are wronged by corporate neglect can get justice and force change. We are living in a world where corporations and govt care less than ever about common people, and I support your work. I hope I will never need your services.

Thank you for posting these accident articles on your site. At the company that I work for, e deal with monitoring construction activity and work around trenches and all sorts of construction equipment/vehicles. I sometimes wonder if construction companies have enough safety training to inform employees of how to protect themselves while on the job.
