Commentary:
The news article paints a clear picture that the driver of the car in this accident may be responsible for the accident, but there is something people need to think about. Was the tractor-trailer on the side of the road parked there legally? If this was a breakdown lane and the truck had suffered a mechanical problem that is one thing. On the other hand, if the trucker had pulled over to take a nap, use the restroom, finish his dinner, or filling out his logbook, then there is a chance that the truck was illegally parked. If this turns out to be the situation, then the trucking company could be responsible for the accident.
We’ve handled a case where the trucker had pulled over to pee into a bottle when a car hit the truck. The trucking company was found liable for the accident because of the actions of their driver. If this turns out to be a similar case, then the trucking company needs to answer for their actions, just as the other company did.
